$250,000 Settlement – Premises Liability – Wrongful Death, Bar Fight

Wrongful Death/Premises Liability: $250,000 Settlement on behalf of 2 children of a man that was struck by an automobile while he was running from a fight outside of a Bar in Boynton Beach. The Bar owner did not have any liability insurance for the incident, but a monetary recovery was obtained from the Property Owner and the auto driver’s insurance company.  The Bar had a long history of violent incidents, and the Bar and the Property Owner did not have adequate security to monitor the premises to prevent similar incidents.  The case was complicated by the potential for comparative negligence being asserted against the deceased for arguably causing the fight to escalate and running a significant distance from the fight into oncoming traffic.
